Terms of Service

These Terms of Service govern the use of the MyDailyDay mobile application operated by Pewter Software Ltd. By using the application you agree to these terms.
1. Eligibility
- You must be 13 years or older to use this application.
- If you are under 18, you may only use this application with the consent and supervision of a parent or legal guardian. By using this application as a minor, you confirm that you have obtained such consent.
2. User Accounts
Users may create accounts using:
- Email and password
- Google Sign-In
Users are responsible for maintaining the confidentiality of their account credentials. Users may update their email address through account settings.
3. Account Deletion
Users may delete their accounts at any time within the application. Upon deletion:
- Personal data associated with the account will be removed
- The deletion is permanent and cannot be reversed
- Local task data stored on the user's device may remain
4. Acceptable Use
Users agree not to:
- Attempt to access other user accounts
- Reverse engineer the application
- Interfere with service operation
- Use the application for illegal purposes
Violation may result in account suspension or termination.
5. Social Features
The application allows users to:
- Add or remove friends
- Link accounts as couples
- Send "poke" notifications
These features are intended for friendly productivity encouragement. Task content is not shared between users. Users are responsible for interactions with others.
6. Subscriptions and Billing
6.1 Subscription Plans
MyDailyDay offers optional premium subscriptions:
- Individual: £5.00/year (GBP)
- Couple: £7.50/year (GBP)
6.2 Payment Processing
All payments are processed through:
- Apple App Store (iOS devices)
- Google Play Store (Android devices)
Pewter Software Ltd does not directly process payments or store payment information.
6.3 Auto-Renewal
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
To cancel auto-renewal:
- iOS: Settings → [Your Name] → Subscriptions → MyDailyDay → Cancel
- Android: Play Store → Account → Subscriptions → MyDailyDay → Cancel
6.4 Refunds
Refund requests must be directed to the platform where you made the purchase:
Apple App Store:
- Visit: reportaproblem.apple.com
- Or contact Apple Support
- Refer to Apple's refund policies for eligibility
Google Play Store:
- Request through Play Store app or website
- Or contact Google Play Support
- Refer to Google's refund policies for eligibility
Important: Pewter Software Ltd cannot process refunds directly. All billing is managed by Apple and Google. We recommend reviewing premium features before purchasing.
6.5 Couple Subscriptions
Couple subscriptions require both users to be linked. If the couple link is removed:
- The subscription remains active for the primary subscriber
- The linked user loses premium access
- No partial refunds are provided for link removal
6.6 Price Changes
We reserve the right to change subscription prices with 30 days' notice. Price changes do not affect existing subscriptions until renewal.
7. Service Availability
We aim to provide reliable service but do not guarantee uninterrupted availability. Features may change, be modified, or discontinued at any time.
8. Limitation of Liability
To the fullest extent permitted by law, Pewter Software Ltd shall not be liable for:
- Indirect or consequential damages
- Data loss
- Productivity losses
- Service interruptions
Use of the application is at the user's own risk.
9. Intellectual Property
All rights to the application, design, and software are owned by Pewter Software Ltd. Users may not copy, distribute, or modify the application without permission.
10. Termination
We reserve the right to suspend or terminate accounts that violate these terms.
11. Governing Law
These terms are governed by the laws of the United Kingdom.
12. Apple App Store EULA
For users who download the app through Apple's App Store, Apple's Standard End User License Agreement (EULA) applies in addition to these Terms of Service.
In case of conflict between these Terms and Apple's EULA, Apple's EULA takes precedence for Apple App Store users.

13. User Indemnification
You agree to indemnify, defend, and hold harmless Pewter Software Ltd, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from or related to:
- Your violation of these Terms of Service
- Your misuse of the MyDailyDay application
- Your violation of any applicable laws or regulations
- Your violation of any third-party rights, including intellectual property or privacy rights
- Any content you submit through the application
This indemnification obligation will survive termination of these Terms and your use of the application.
14. Dispute Resolution
If you have a dispute with Pewter Software Ltd regarding the MyDailyDay application or these Terms, we encourage resolution through the following process:
- Negotiation: Contact us at pewtersoftware@gmail.com to attempt resolution through good faith negotiation
- Mediation: If negotiation fails, disputes may be resolved through informal mediation
- Legal Action: Any legal claims shall be brought in the courts of the United Kingdom under UK law
Individual Disputes: You agree to resolve disputes with us on an individual basis and waive any right to participate in class action lawsuits or class-wide arbitration.
Governing Law: These Terms are governed by the laws of England and Wales.
